Kevin Phillips’ practice focuses on all aspects of Warehouse Legal Liability, including property losses, contract drafting, review and negotiation, general liability, regulatory compliance, instituting and enforcing warehousemen’s liens, and commercial litigation. He represents warehouses in tort, contract, bailment, warranty, and statutory-based actions.

Phillips has defended warehousemen against a myriad of claims, such as:

  • Chemical contamination of food-grade products stored in a newly constructed 600,000-square-foot warehouse
  • Ammonia exposure to food products stored in an underground refrigerated facility
  • Infestation of products involving multiple distribution centers
  • Improper record-keeping at a human blood storage facility
  • Food spoliation claims involving alleged improper refrigeration by warehouseman
  • Cross-contamination of a cocoa manufacturer’s products via spices stored nearby
  • Inventory shortage claims against distribution center brought by a cocoa manufacturer against warehouseman 
  • Product damage claims as a result of natural disasters
  • Recovery of unpaid storage charges

Phillips has extensive experience in drafting, negotiating, and reviewing warehousing documents, including being retained to update industry forms from the two largest warehouse associations in the United States: 

He is a member of several warehouse associations, including the International Warehouse Logistics Association (IWLA), where he serves as General Counsel for the Association and its captive insurance program. Phillips is also Claims and Litigation Counsel for The Global Cold Chain Alliance (GCCA) and The International Association of Refrigerated Warehouses (IARW). Associations and organizations across the country regularly ask Phillips to present the latest warehouse law trends and teach at education events.
